I am battling Allsnake for my daughter. In 1999, my entire family was hit head-on by another driver who crossed the center line. My 3 year old daughter sustained a fractured skull and closed head injury, and, as you can imagine, severe emotional trauma. I have been at war with these people for 3 years and counting. Every medical bill is denied, and it took 2 1/2 years to be reimbursed for the $700.00 ambulance bill. I have paid 90% of all medical bills myself to keep my credit in good standing. I have been through 5 claims adjustors, none of which knew what they were doing. Our file has now been turned over to a "Specialist" in dealing with severe medical conditions, who cannot return a phone call or answer any correspondence. I have spent over $250.00 on faxes and registered mail because each time I submit any bill for my daughter, I am told by Allsnake that "there is just no file material on your daughter. We don't actually know if she was injured or not."
Even the treating hospital sent them a letter stating her medical records had been requested over 7 times, and they are getting suspicious. I cannot find an attorney to handle this because I would have to sue for each bill separately, and there is no money in that for lawyers. As of March 2002, they owe me $9,000.00 just in medical bills I have had to pay myself. That is after my health insurance, which is primary, has paid their 80%. I have even submitted pictures taken in the months after the accident, showing a large forehead hematoma, and black and blue swollen shut eyes. This is not enough for them. My daughter's pediatrician has sent numerous letters attesting to the condition of my child, even complications she has now. This is also not good enough. It is one thing to fight for yourself, and sometimes deal with the fact that you're being screwed and there is nothing you can do about it, but it is another when it is your child. The other drivers insurance company read the medical reports, saw the pictures, and contacted ME regarding an offer. At least my daughter will have something from this ordeal when she turns 18. In the meantime, I am basically working to keep up on the doctors visits, MRI's, CT Scans, psychological evaluations, etc. There is no end, and no help from Allsnake. I just keep plugging along for my daughter's sake, hoping there will be an end to this soon.
MY POINT IS THEY ARE CORRUPT AND DOING PEOPLE WRONG.
If anyone has insurance with these people please cancel and help spread the word about their wrong doings. The only way to fight large companies is with the lose of accounts and money.
"There is no incentive for insurance companies to do what is right, such as live up to the promises made in their policies. Tort reformers fueled by insurance money think big business and the insurance industry need to be protected against "runaway juries." It's the other way around. Big business and the insurance industry have always been able to take care of themselves. The little people need protection from them. This country was founded on the common law right of the little guy to get into court with his hired gun to fight the oppressor, be it big government or big business. Take that away and we have nothing left. Look around. It's being whittled away, bit by bit, caps on damages here, restrictions on jury trials there. It won't end until we recognize the enemy and join together to take a stand against them. It will take the little people to do this together".
